开工日期：指双方在协议书中约定，乙方开始施工的绝对或相对的日期。

Commencing date: the date, absolute or relative, on which Party B starts the stipulated construction agreed by both parties in the agreement.

The Commencement Date: The date on which the Contractor commences the construction hereunder as specified in the agreement.

开工日期：指发包人承包人在协议书中约定的承包人开始施工的日期。

除专用合同条款另有约定外，承包人应按照第7.1款〔施工组织设计〕约定的期限，向监理人提交工程开工报审表，经监理人报发包人批准后执行。开工报审表应详细说明按施工进度计划正常施工所需的施工道路、临时设施、材料、工程设备、施工设备、施工人员等落实情况以及工程的进度安排。

Unless otherwise specified in the terms of the particular contract, the contractor shall submit to the supervisor the report form of construction commencement in accordance with the term stipulated in sub clause 7.1 [Construction Organization Design]. The report form shall be executed subsequent to the employer’s approval. The report form of commencement should make illustrations of the implementation on the work road, temporary facilities, materials, engineering equipment, construction equipment, construction personnel, etc., which are necessary for construction progress plan, and the schedule of the works progress.

除专用合同条款另有约定外，合同当事人应按约定完成开工准备工作。

Except otherwise agreement of contract, parties hereto should pursuant to the agreement accomplish the preparation of commencement.

发包人应按照法律规定获得工程施工所需的许可。经发包人同意后，监理人发出的开工通知应符合法律规定。监理人应在计划开工日期7天前向承包人发出开工通知，工期自开工通知中载明的开工日期起算。

The employer shall, in accordance with the stipulations of law, obtain the necessary permission and approval for the construction of the works. The Commencement Notice issued by the supervisor shall, subject to the employer’s approval and comply with the stipulations of law. The supervisor shall, 7 days prior to the scheduled commencement date and the work term will be calculated from the commencement date which is stated in Commencement Notice.

除专用合同条款另有约定外，因发包人原因造成监理人未能在计划开工日期之日起90天内发出开工通知的，承包人有权提出价格调整要求，或者解除合同。发包人应当承担由此增加的费用和（或）延误的工期，并向承包人支付合理利润。

Unless otherwise specified in the particular condition, where the supervisor fails to issue Commencement Notice due to the employer’ reason, within 90 days from the scheduled commencement date, the contractor reserve the right to raise the requirement of price adjugement or termination of contract. Employer should bear the increased cost and / or delayed term arising therefrom in addition to make payment of reasonable profits to the contractor.

除非合同协议书另有说明，雇主应在不少于7天前向承包商发出开工日期的通知;

Unless otherwise stated in the Contract Agreement, the Employer shall give the Contractor not less than 7 days’ notice of the Commencement Date; and

开工日期应在第1.6款[合同协议书]规定的合同全面实施和生效日期后42天内。

the Commencement Date shall be within 42 days after the date on which the Contract comes into full force and effect under Sub-Clause 1.6 [Contract Agreement].

承包商应在开工日期后，在合理可能情况下尽早开始工程的设计和施工,随后应以正当速度拖延地进行工程。

The Contractor shall commence the design and execution of the Works as soon as is reasonably practicable after the Commencement Date, and shall then proceed with the Works with due expedition and without delay.

“开工日期”指的是钻机到达公司的第一口井井场或指定的其它井场，承包商各个岗位人员齐备，从各方面都已具备开钻水平，并在以下规定的合同期间内，以钻机制造商标定的技术规范，达到能够进行持续施工状态的时刻。钻机一旦到达井场，承包商应立即以书面形式通知公司。

'Commencement Date' means the date and time of arrival of the Rig at the first well or other location specified by COMPANY, provided CONTRACTOR’S full crew is in all respects ready to spud and sustain continued drilling operations at manufacturer's rated specification during the Contract Period as defined below. CONTRACTOR shall notify COMPANY in writing immediately upon the Rig's arrival.

发包人必须按合同规定支付定金，收到定金作为设计人设计开工的标志。未收到定金，设计人有权推迟设计工作的开工时间，且交付文件的时间顺延。

The employer shall pay the down payment in accordance with stipulations of the Contract. Reception of the down payment is the mark of commencement of design work for the designer. If the down payment is not received, the designer is entitled to put off the time of commencement of design work, and postpone accordingly the time of delivery of documents.

乙方应当按照协议书约定的开工日期开工。乙方不能按时开工，应当不迟于协议书约定的开工日期前7天，以书面形式向甲方代表提出延期开工的理由和要求。甲方代表应当在接到延期开工申请后48小时内以书面形式答复乙方。

Party B shall commence the construction as per the agreement. In case the commencement cannot be on time, the commencement shall not be later than 7 days than the agreed date and the postponement shall be explained to Party A’s representative and requested in writing, who shall give a written reply to Party B within 48 hours upon receipt. In case no reply is made within 48 hours, it shall be regarded Party A’s representative has agreed on the postponement and the progress schedule shall be postponed accordingly. If Party A’s representative does not agree on the postponement or Party B fails to submit a request for postponement within the stipulated period, the construction period shall not be postponed.

承包人应当按照协议书约定的开工日期开工。承包人不能按时开工，应当不迟于协议书约定的开工日期前4天，以书面形式向工程师和发包人代表提出延期开工的理由和要求；只有在接到工程师和发包人代表明确的书面答复后，工期才能相应顺延。工程师和发包人代表不同意延期要求或承包人未在规定时间内提出延期开工要求，工期不予顺延。

The Contractor shall commence construction on the Commencement Date as agreed in the Agreement. If the Contractor cannot commence on time, the Contractor shall submit to the Engineers and the Employer’s Representative requirement in writing for deferring the commencement with the necessary reasons not later than 4 days before the Commencement Date as set out in the Agreement. The Project Period can be extended accordingly only after the written explicit approval is obtained from the Engineers and the Employer’s Representative. If the Engineers and the Employer’s Representative disagree on the requirement on deferring the commencement or the Contractor fails to submit the requirement within the prescribed time limit, the Project Period cannot be extended.

Under special circumstances, the Employer may notify the Contractor in writing to defer the Commencement Date and the Project Period shall be extended accordingly. However, the Contractor will not make any requirements for Expenses against the Employer.

在特殊情况下，发包人可书面通知承包人推迟开工日期，工期相应顺延，但承包人不会向发包人提出任何费用要求。

发包人应在开工日期前7天用书面形式向承包人发出进场通知。承包人应在合同规定的开工日期的3天前接收工地。

The Employer shall issue a written move-in notice to the Contractor 7 days before the Commencement Date. The Contractor shall take over the Site 3 days before the Commencement Date as stipulated in the Contract.

开工日应为本协议生效日____个月之后的第___天，但C可在开工日之前开始修建进厂通道、勘探、测量和现场清理等。如果C按照第9.1款的规定开始土建工作，开工日应为C实际开始土建工作的日期，C应通知B。

The commencement date shall be the ____day after____months rom the Effective Date of this Agreement provided that C can start work or access road， survey， investigation，clean-up work around the site，tc. before the commencement date. However，if C commences construction ork in accordance with the provision of Clause 9.1，the commencement date hall be the date where C materially starts the construction work，which hall be notified to B by C.

承包商在接到工程师有关开工的通知后，应在合理可能的情况下尽快开工，开工通知应在中标函颁发日期之后，在投标书附件中规定的期限内发出。此后，承包商应迅速且毫不迟延开始工程的施工。

The Contractor shall commence the Works as soon as is reasonably after the receipt by him of a notice to this effect from the Engineer, which notice shall be issued within the time stated in the Appendix to Tender after the date of the Letter of Acceptance. Thereafter, the Contractor shall proceed with the Works with due expedition and without delay.

This project contract time limit for a project is 60 days (calendar day begins from the operation, it does not contain design time limit for a project).

本工程合同工期为60天（日历天从开工之日起算起，不含设计工期）

2、The operation date ____; completion date ___.

本工程开工日期____ 年 __ 月 __ 日，竣工日期____ 年__ 月___日。

The contractor does not start work on the Site until the first possession date and does the work so that Completion is on or before the Completion Date.

承包商从第一个现场占有日起开始施工作业，并应在竣工日或竣工日前竣工。

开工日期是指合同资料表B中所列最迟发生的条件的事发日。如合同资料表B中未列出任何条件，则开工日为合同签订日。

The Commencement Date shall be the date on which the latest of the events listed in Contract Schedule B has occurred. If no event has been listed in Contract Schedule B, the Commencement Date shall be the date of signature of this Contract.

未满足开工条件。如项目未能根据3.2款开工，则在签订日后6个月内（或其他双方商定的时限，见合同资料表C），任何一方都可以书面通知对方终止合同。

Non-occurrence of the Commencement Date. If the Commencement Date has not occurred, according to Article 3.2, within six(6) months from the date of signature (or within such other term as may be agreed between the Parties: see Contract Schedule C), either Party may terminate the Contract by written communication to the other Party.

The Contractor shall commence the Works right after the Effective Date according to the time schedule as described in Appendix 4 of the Contract.

承包商须在合同生效日后，立即按照合同附件4 的时间进度要求开始工作。

以上各井的开工日期以经批准的开工报告日期为准，日历工期不含附属工程及堵水注浆的工期，其工期另行约定。

The approved start date is applicable as the start dates of the above shafts are concerned. The calendar time limit does not include time limits for auxiliary projects including grouting for leaking water. These time limits should be determined specially.

乙方按照批准的开工日期组织开工，如果不能按时开工，乙方应在确定的开工日期 15 个工作日之前，向甲方提出延期开工的理由和要求，并经同意，其交工日期相应顺延。

Party B should, pursuant to the approved commencement date organize Work’s commencement, if fail to do so, should on or before 15 working days prior to the approved date of commencement, submit to party A with the reason and requirement of extension, and the date of project delivery may be correspondingly extended subject to party A’s consent.

如果因乙方自身的原因在开工日或经甲方同意顺延的开工日届满后的 3 个月期满后未能开工，甲方视为乙方放弃该项目，甲方有权终止本合同。

In case of failure of commencement for party B’s reason after expiration of three months on and from the commencement date or the extended date which is agreed by party A, party A will deem party B to waiver the project and has rights to terminate this contract.
