昨日，有一艘被滞留船的船长给我发了一封很长的邮件，委屈并认真的想了解这条缺陷对不对：
15108：Reports of non-conf., accidents & hazardous occur.
IT IS FOUND THAT THE SAMPLING COCK OF OWS HAS BEEN SEALED AT CLOSE POSITION DURING RUNNING TEST OF PSC INSPECTION.IT IS ALSO APPROVED BY ORB 4 TIMES SINCE 19-03-2018.THE ABOVE MENTIONED OPERATION WAS NOT FOLLOWED BY INSTRUCTION BOOK WHICH REQUIRES THE COCK TO BE KEPT OPEN DURING NORMAL OPERATION. AS THE SAME DEFICIENCY RAISED BY CHINA MSA ON 26-04-2017 WAS NOT RECTIFIED AS REQUIRED, ROOT CAUSE OF INVESTIGATING AND ANALYZING OF NONCONFORMITIES NEED TO BE DIG OUT AND ADDITION AUDIT REQUIRES ALSO.
船长讲他们船4月28日被PSCO滞留了，这一缺陷尤为严重，这条缺陷有些长，大意是：PSC检查测试期间，油水分离器取样口处于关闭位置，跟据油类记录簿记录，这一测试自2018年3月19日至今，已经进行了4次。上面的这一测试操作没有按照油水分离器说明书的要求进行操作，这一缺陷在2017年4月26日的PSC检查中，中国海事局曾提出过，并且没有整改。综上分析，船舶应该深挖不符合项，并进行附加审核。
很理解船长的心情，体系缺陷一个顶五个，并且要求公司进行附加审核，这么一搞，船长老轨要承担点责任了。这艘船取样水开关为什么封闭不晓得，该轮的老轨可以私密解释下。船长的疑惑是：一个小缺陷上升到体系审核，PSCO有这个权利么？
9 不合格、事故与险情的报告及分析
9.1 SMS 应包括确保向公司报告、调查和分析不合格、事故及险情的程序，以便改进安全及防污染能力。(The SMS should include procedures ensuring that non-conformities, accidents and hazardous situations are reported to the Company, investigated and analyzed with the objective of improving safety and pollution prevention.)
9.2 公司应建立实施纠正措施的程序。(The Company should establish procedures for the implementation of corrective action)
如上，ISM规则第9条中指出SMS体系中应包括向公司报告、调查和分析不合格的程序，显然本案例中2017年4月26日的PSC检查中发现的缺陷可以作为一项不符合项目，应该向公司报告，按照公司管理的经验，一般PSC检查报告会第一时间发向公司，这样算不算已经报告了呢？
A.1119(30)附录8是用来指导关于PSCO如何开展ISMcode检查的
其中明确：PSCO不是体系审核员，不履行安全管理审核，仅核查当天船舶的状况（Port State control officers (PSCOs) do not perform safety management audits. PSCOs conduct inspections of ship, which are a sampling process and give a snapshot of the vessel on a particular day.）
如果上一次PSC检查中的ISM相关缺陷，需要三个月内关闭。而三个月之后的PSC检查时，内部的安全审核没有开展，基于这个事实PSCO可以考虑滞留船舶（If an outstanding ISM-related deficiency (to be rectified within three months) from a previous PSC inspection exists and no objective evidence can be provided by the master of the ship, during the current PSC inspection more than three months later, that an internal safety audit has been performed, any further action will be taken based on the professional judgement of the PSCO and may warrant the detention of the ship.）而4月份的缺陷是：（14104 Oil filtering equipment THE OWS CONTINUE TO NORMALLY WORK AFTER THE SAMPPLING WATER SUPPLY LINE V/V CLOSE ），并不是体系相关的缺陷。显然这一条不能作为依据。
再者，导则中给出了几项可以作为滞留的情形十项，如下：
7.3.1 The following are deficiencies which may warrant detention:
.1 deficiencies of technical and/or operational nature which individually or collectively provide objective evidence of a serious failure, or lack of effectiveness, of the implementation of the ISM Code;（技术缺陷说明没有有效执行ISMcode）
.2 there is no SMC, interim SMC and/or copy of the DOC or interim DOC on board the ship;（SMC DOC证书不在船）
.3 there is no valid SMC or interim SMC on board;（SMC无效）
.4 the SMC intermediate verification is overdue;SMC证书过期
.5 the SMC is expired and there is no objective evidence of an extension issued by the Administration; or where the SMC has been withdrawn by the Administration;SMC过期，并且主管机关没有延期或撤销
.6 the DOC or interim DOC is expired or withdrawn;DOC过期或撤销
.7 the ship type as indicated on the SMC or interim SMC is not listed on the DOC or interim DOC;SMC和DOC中船型不一致
.8 evidence of the DOC annual verification is not available on board;DOC年检证据不存在
.9 the certificate number on the copy of the DOC and the endorsement pages are not the same; and DOC上的证书编号和签注页不一致
.10 the Company name, the Company address or the issuing Government authority on the DOC or interim DOC is not the same as on the SMC or interim SMC. （DOC和SMC证书上的船公司地址，公司名称、主管机关不一致）
显然上面十项可滞留缺陷只有两类，一类是DOC、SMC证书有问题，一类是技术类缺陷说明ISM规则没有有效进行。
本案例中的缺陷依据应该怎么算，期待大神告知，再者导则中没有找到给予PSCO要求附加审核(ADDITION AUDIT)的权利。
