But the stevedores not spread enough wooden dunnage and packing materials on the tank top flat floors in holds no.1 & 4.  this could cause ship’s plates and structure deformed or damaged. Also, this could cause the cargo which loaded on the bottom of each holds deformed or damaged.   

I hereby notes his protest against these stevedores not spread of enough wooden dunnage and packing materials on the tank top flat floors which may caused ship’s plates and structures or her cargo deformed/damaged as well as all expense,losses , stoppages and/or delays caused thereby, reserving the rights to extend the same whenever and wherever necessary.

Therefore, the ship’s crew, the ship and her owners not responsible for any cargo deformed/damaged/rejected at discharge port as well as problems/troubles,expenses,stoppage/delays caused thereby.

3.对于港内疫情期间装货期间不允许船员出生活区可能导致看管货物不周的抗辩书

The subjected vessel was loading general cargo at yr good port. But according to port regulations,  due to port policy of covid-19 control reason, all crew not allowed to go outside of accommodation for monitoring ,checking & counting her cargoes during the cargo operation.

To fear of cargo deformations/damage/bad quanlity/shortage which loaded on board.

I hereby notes this protest against these potential or undiscovered deformations/damage/bad quanlity/shortage of her cargo loaded as well as all expense ,losses , stoppages and/or delays /cargo rejection at disport caused thereby, reserving the rights to extend the same whenever and wherever necessary.

Please kindly note,I,Master of M/v " X" hereby lodge a letter of protest in respect of PP/PE WOVEN BAG FERROUS SULPHATE HEPTAHYDRATE being loaded at port of SHANGHAI.

I protest against that you make improper stowage on board our vessel with respect to the PP/PE WOVEN BAG FERROUS SULPHATE HEPTAHYDRATE were stowed in hold No.4 and we found some PP/PE WOVEN BAG FERROUS SULPHATE HEPTAHYDRATE under S/O No.: SXSHIS01 were stacked at hold No.4 the left and right side up to five layers,some of cargo impending without support. When the ship sailing in the Indian Ocean encounters the Indian Ocean monsoon, the PP/PE WOVEN BAG FERROUS SULPHATE HEPTAHYDRATE maybe swaying and sliding and damage. We strongly require safe stowed to ensure the safety of the ship and the cargo, but the port side has not made any rectification.

Considered the above unreasonable may likely to cause more damage during further unanticipated sea voyagethus,I Master of M/v"X" lodge this protest and my ship and owner are not responsible for any damage, loss, claim and consequence arising from subject situation and reserving my right to extend it at any time and place accordingly.

5. 对于舱内货物袋装货物堆装过高和货物底部支撑,衬垫问题抗辩书

The subjected vessel was loading general cargo at yr good port. But the stevedores not spread enough wooden dunnage between different types of cargos .This could cause cargo deformed ,fall and collapse.

In  addition ,the number of stacked layers of some cargo is too high,which may lead to crushed .inadequate lashing of cargo in hold and deck may cause cargo movement ,resluting in damage to the cargo and ship.

 I hereby notes his protest against these stevedores not spread of enough wooden dunnage between different types of cargo,and stack too high and not sufficiently lashing ,which may caused  cargo deformed ,fall,collapse, crushed. As well as all expense ,losses , stoppages and/or delays caused thereby, reserving the rights to extend the same whenever and wherever necessary.

I protest against that you used the chain as a cargo lifting tool to load SM2207-94J pipes. Using the chain as a cargo lifting tool may lead to scratches on the outer surface of the SM2207-94J pipes and damage to the surface coating. Once the coating is damaged, further corrosion cannot be prevented.

I protest against that you loading of ammonium chloride (SXRZDK01) on SM2207-94J pipes , because ammonium chloride has strong corrosion on copper,steel and stainless steel, which may lead to serious rust on the surface of SM2207-94J pipes.According to the stowing plan, steel pipe cargo is used as the bottom cargo of the tank floor, which may lead to deformation of steel pipe. In addition, the insufficient number of mat wooden placed at the bottom of the SM2207-94J pipes may also lead to the deformation of the bottom of the cargo hold and the SM2207-94J pipes .

I protest against that you loading of SXRZIS14 galvanized Angle steel direct contact between the cargo and the bulkhead surface of the cargo hold without put any pad wood . This may lead to wear of the protective coating on the surface of the galvanized Angle steel, so that the galvanized Angle steel rust. The stacking disorder of galvanized Angle steel surface is uneven. Laying steel plate on the surface of galvanized Angle steel and the excavator working on the steel plate may lead to the deformation of galvanized Angle steel and the fracture of binding band.

I protest against that you load cargo on the top of SXDLHD 01/02 POLYETHYLENE TEREPHTHALATE, because SXDLHD 01/02 POLYETHYLENE TEREPHTHALATE is application manufacuring bottles for carbonated soft drinks ,fruit juice and water and food oil at hold 2 and hold 5.However, according to the loading plan of Rizhao Port, loading cargo on the top of SXDLHD 01/02 POLYETHYLENE TEREPHTHALATE may cause serious contamination of the cargo.Laying steel plate on the surface of SXDLHD 01/02 POLYETHYLENE TEREPHTHALATE bags and the excavator working on the steel plate may lead to SXDLHD 01/02 POLYETHYLENE TEREPHTHALATE outer packaging is dirty and broken.

I protest against that you loading of SXRZVN23 POLYETHYLENE TEREPHTHALATE unreasonable loading method which leads to the collapse 。Due to the unreasonable loading of SXRZVN08 R-PSFIBER, the height around the cargo is low and the middle of the cargo is high, forming a surface of cargo loaded with a projecting hill. As a result, when the SXRZVN23 POLYETHYLENE TEREPHTHALATE are loaded , they will fall to the lower position in the surrounding cargo hold, which leads to the collapse of many cargos and Cause difficult unload at discharge port .

Considered the above risk factors in the loading process and may likely to cause more damage during further unanticipated sea voyage. Please kindly note,I,Master of M/v "X" hereby lodge a letter of protest in respect of FILM FACED PLYWOOD(SXRZIS10, SXRZVN09, SXRZVN10, SXRZVN11, SXRZVN12, SXRZVN15, SXRZVN18, SXRZVN19, SXRZVN20,) being loaded at port of RIZHAO.

I protest against that you loading FILM FACED PLYWOOD with serious quality problems at your good port。In the process of loading FILM FACED PLYWOOD , I found the following serious problems exist. During the loading process,the improper operation of the workers caused the damage of the outer package of the FILM FACED PLYWOOD and the deformation of the cargos .The outer packaging is insufficient, there are many broken, scratches on the cargo exposed surface. Some plywood strapped insufficiently,missing strapping bands.Due to the FILM FACED PLYWOOD are not packed insufficient , and the high number of stacking layers may further aggravate the damage of the cargos.Some of the FILM FACED PLYWOOD loaded in the dark cargo hold appeared strapping bands broken, loosen,and dislocated .As a result, may Cause difficult  unload at discharge port .

I protest against that you loading of heavy goods on the surface of FILM FACED PLYWOOD. During the loading operation , I found a lot of heavy cargo loading on the surface of FILM FACED PLYWOOD in HOLD 2 and HOLD 4. This may lead to deformation ,fracture and damage of the FILM FACED PLYWOOD .

Considered the above risk factors in the loading process and may likely to cause more damage during further unanticipated sea voyage. I protest against that you Unreasonable dunage and stowing during the loading operation at RIZHAO port. For example, cargo hold2 loaded heavy cargos on the surface of FILM FACED PLYWOOD , May lead to FILM FACED PLYWOOD deformation and fracture. Some of the cargos loaded on the surface of the FILM FACED PLYWOOD are found leaking water from the cargo of wooden box package, may cause the below  FILM FACED PLYWOOD damage .Cargo hold3 loaded heavy cargos on the bagged cargo, may cause the bagged cargos damaged, Uneven bottom of heavy cargos may cause cargos shift and lashing band broken .As a result cargo damage and ship damage. The same problem was found at Hold4 ,Improper combination of cargos  in Hold 4 and stacking disordered of  cargos lead to insufficient of lashing, which may lead to shift of cargos and ship damage . Same broblem of stacking cargos in cargo Hold 5 ,which May cause collapse of cargos,broken out package and difficult unloading. some cargos loaded on deck are not securely wrapped with tarpaulin, which may lead to cargo damage due to rain and wave.

Considered the above risk factors in the loading process and may likely to cause more damage during further unanticipated sea voyage.
